25 Pa. Code § 290.409 - Storage impoundments-general requirements
A person that operates a storage impoundment to hold coal ash shall meet the following conditions:
(1) Hold a valid permit from the Department for the storage under sections 308 and 402 and other applicable provisions of The Clean Streams Law (35 P. S. §§
691.1-691.1001), Chapter 91 (relating to general provisions) and other applicable regulations promulgated thereunder, and shall comply with the permit.
(2) Comply with Chapter 105 (relating to dam safety and waterway management).
