25 Pa. Code § 83.221 - Applicant eligibility
(a) An
owner of an agricultural operation existing as of October 1, 2006, may apply
for financial assistance for the implementation of plans developed under the
act. The owner shall have legal and financial responsibility for the
agricultural operation during the term of the financial assistance provided by
the Commission.
(b) Existing CAOs
required to implement BMPs to conform with the revised criteria of this
subchapter are eligible for financial assistance for the implementation of the
BMPs.
(c) New agricultural
operations coming into existence after October 1, 2006, are not eligible for
financial assistance for the implementation of their approved plan, including
the BMPs in the plan.
(d) Existing
NMP operations having an approved nutrient management plan that are currently
or were in violation of the plan submission requirements or any other
requirements of this act prior to October 1, 2006, are not eligible for funding
under this program.
(e) Existing
agricultural operations expanding to become a CAO after October 1, 2006, are
not eligible for financial assistance for the implementation of their approved
plan, including the BMPs in the plan.
(f) Only those agricultural operations having
over eight AEUs are eligible to receive financial assistance for the
implementation of their approved plan, including the BMPs in the
plan.
