49 Pa. Code § 37.71 - Form of application
(a)
Applications for certificate of approval of fictitious name or corporate name
shall be made on forms provided by the Board prior to submission of articles of
incorporation or fictitious name registrations to the Corporation Bureau of the
Department of State. The file shall identify the parties with an ownership
interest in the business and the licensed and unlicensed professional
staff.
(b) Applications shall be
accompanied by a nonrefundable fee in the amount prescribed by law. Incomplete
applications and applications not accompanied by the proper fee will be
returned to applicants with a statement of the reason for return.
(c) The Board will approve the use of a
fictitious name or corporate name, if at least one of the persons filing for
the use of the name, one of the incorporators of a proposed corporation, or one
of the directors of an existing corporation, has been properly registered as a
professional engineer or professional land surveyor in this
Commonwealth.
(d) Upon approval of
an application for certificate of approval of a fictitious name or corporate
name, the Board will issue a certificate of approval to the Corporation Bureau
of the Department of State. If an application is rejected, the Board will
advise the applicant of the reason for rejection.
