51 Pa. Code § 13.3 - Opinions
(a) Opinions
shall be issued under the provisions of
65 Pa.C.S. §
1107(10) (relating to powers
and duties of commission).
(b)
Requests for Commission opinions will be considered in accordance with the
procedures outlined in §§
23.1-23.6.
(c) A party may request that the Commission
reconsider an opinion in accordance with
21.29 (relating to finality;
reconsideration). The request shall be filed within 30 days of the service of
the opinion and contain a detailed explanation of the reasons in support of the
request.
(d) Reconsideration may be
granted in the discretion of the Commission under §
21.29(e).
(e) A person who acts in good faith on an
opinion issued to him by the Commission will not be subject to criminal or
civil penalties for so acting, if the material facts are as stated in the
opinion request.
