52 Pa. Code § 69.104 - Reliance upon compliance certification copy; effect of reliance
(a) The receipt by
a public utility of the compliance certification copy constitutes conclusive
evidence to the utility that the residential building, for which electric
service has been requested, has been or will be constructed in compliance with
the building energy conservation standards. Public utilities shall rely
absolutely on the compliance certification copy in furnishing electric service
to or for a residential building, and no public utility, which is in receipt of
the compliance certification copy may conduct an audit, examination or
inspection of the residential building for the purpose of determining
compliance with the building energy conservation standards.
(b) The furnishing, rendering or supplying of
electric service to or for a residential building by a public utility, in
reliance upon the compliance certification copy may not constitute a
certification or determination by the utility that the residential building has
been constructed in compliance with the building energy conservation
standards.
