Tenn. Comp. R. & Regs. 0400-20-07-.16 - LICENSE ISSUANCE AND SPECIFIC EXEMPTIONS
(1) The
Division shall issue a license for the medical use of radioactive material if:
(a) The applicant has filed an application
with the Division in accordance with the instructions in Rule
0400-20-07-.11;
(b) The applicant
has paid applicable fee under Rule 0400-20-10-.31;
(c) The Division finds the applicant equipped
and committed to observe the safety standards established by the Division in
these regulations for the protection of the public health and safety;
and
(d) The applicant meets the
requirements of Chapter 0400-20-10.
(2) The Division shall issue a license for
mobile medical service if the applicant:
(a)
Meets the requirements in paragraph (1) of this rule; and
(b) Assures that individuals or human
research subjects to whom unsealed radioactive material, or radiation from
implants containing radioactive material, will be administered may be released
following treatment in accordance with Rule 0400-20-07-.35.
(3) The Division may, upon
application of any interested person or upon its own initiative, grant
exemptions from this Chapter that it determines are authorized by law and will
not endanger life or property or the common defense and security and are
otherwise in the public interest. .
