Tenn. Comp. R. & Regs. 0720-10-.08 - TRANSFER OF A CERTIFICATE OF NEED
(1) The Agency may
approve the transfer of a certificate of need after the Agency determines that
the new holder of the certificate of need would provide health care that meets
appropriate quality standards, and that the transfer would not reduce access to
consumers, particularly those in underserved communities; those who are
uninsured or underinsured; women and racial and ethnic minorities; TennCare or
medicaid recipients; and low income groups;
(2) The Agency will consider a written
request with supporting evidence at the first Agency meeting occurring two (2)
weeks after the Executive Director has deemed the submission complete. The
Executive Director's deeming the written submission complete shall not be
considered to be a determination that the statutory requirements for approval
have been satisfied. The Executive Director may make a recommendation for
approval or denial of the request.
