1 Tex. Admin. Code § 357.489 - Notice of Hearing
(a) The referring
agency must give the petitioner written notice of hearing in accordance with
2001.052, Texas Government Code.
(b) The referring agency must serve the
notice of hearing on the petitioner or petitioner's representative by any of
the following methods using the petitioner's or representative's last known
address or facsimile number as shown by the referring agency's records:
(1) hand-delivery;
(2) courier-receipted delivery;
(3) certified or registered mail;
or
(4) facsimile
transmission.
(c) The
notice of hearing shall include a disclosure, in at least twelve-point,
bold-face type, that the factual allegations listed in the notice of adverse
action could be deemed admitted, and the relief sought might be granted by
default against a party that fails to appear.
