1 Tex. Admin. Code § 357.643 - Maximum Amount
The maximum amount of the civil monetary penalty is:
(1) the amount that DHS or its health
insuring agent pays because of the false claim and the interest on that amount
determined at the rate provided by law for legal judgments (Texas Civil
Statutes, Article 5069-1.05) accruing from the date on which the payment was
made; plus
(2) twice the amount
that DHS or its health insuring agent pays because of the false claim;
plus
(3) $2,000 or less for each
item or service for which payment was claimed.
