1 Tex. Admin. Code § 357.645 - Determining the Amount

To determine the amount of a civil monetary penalty, DHS considers the following:

(1) the seriousness of the violation;

(2) the person's history in submitting claims; and

(3) the amount necessary to deter the person from submitting false claims in the future.
