16 Tex. Admin. Code § 111.174 - Refunds
(a) The commission or executive director may
order an audiologist to pay a refund to a consumer who returns a hearing
instrument(s) during the 30-day trial period required by the rules adopted
under Subchapter W (regarding Joint Rule Regarding the Sale of Hearing
Instruments).
(b) If the 30-day
period ends on a Sunday or a holiday, then the 30-day period shall not expire
until the next business day.
(c)
The licensee shall have thirty (30) days from the date of a consumer's return
of the hearing instrument(s) to reimburse the consumer.
(d) In the event that the licensee fails to
reimburse the consumer within the prescribed period in subsection (c), then the
licensee may be subject to additional penalties and/or sanctions provided for
under the Act and rules.
