16 Tex. Admin. Code § 313.4 - Approval of Officials
(a) Each individual
who is designated as an official for a race meeting must be approved by the
executive secretary before the individual begins acting in an official
capacity.
(b) Not later than the
30th day before the first day of a race meeting, an association shall submit to
the executive secretary the name of each individual appointed to serve as an
official at the race meeting. The executive secretary may require the
association to submit a brief job description for each of the officials and a
summary of the proposed official's qualifications. The executive secretary may
refuse to approve an individual as an official if the executive secretary
determines the individual lacks sufficient qualifications to perform the duties
of the official position.
(c) The
executive secretary may rescind the approval of an official if the executive
secretary determines that:
(1) the official
has violated the Act or the Rules;
(2) the official has not fulfilled the duties
of the position for which the official was appointed; or
(3) the official has engaged in conduct that
is inconsistent with the duties of the official and that is not in the best
interests of racing.
