16 Tex. Admin. Code § 33.103 - Notice and Opportunity for Hearing
If an emergency order is issued without a hearing, the executive director or his designee shall set the time and place for a hearing to affirm, modify, or set aside the emergency order. The hearing shall be conducted by the State Office of Administrative Hearings and the decision rendered by the Administrative Law Judge is final.
