16 Tex. Admin. Code § 33.60 - Request for Hearing on Recommendation of Application Denial
(a) If the executive director recommends
denial of an application for a license or permit, notice of the recommendation
shall be transmitted to the applicant by the commission.
(b) An applicant may request an
administrative hearing on the executive director's denial recommendation by
filing a written request for hearing with the commission within thirty (30)
days of the date on the notice of the denial recommendation.
(c) A request for hearing under this section
must be filed by mail to Texas Alcoholic Beverage Commission, ATTN: Clerk, P.O.
Box 13127, Austin, Texas, 78711 or by electronic mail to
clerk@tabc.texas.gov.
(d) If the
applicant files a timely request for hearing, the executive director will refer
the application to SOAH for a hearing pursuant to Alcoholic Beverage Code
§
11.43(h).
(e) If the applicant does not file a timely
request for hearing, the recommendation for denial of the application will be
set for consideration by the commission at the next available regular
commission meeting.
