16 Tex. Admin. Code § 4.112 - [Effective 7/1/2025] Authorized Recycling
(a) Produced water
recycling is authorized if:
(1) produced water
is recycled for use in drilling operations, completion operations, hydraulic
fracturing operations, or as another type of oilfield fluid to be used in the
wellbore of an oil, gas, geothermal, or service well;
(2) produced water recycling pits are
operated in accordance with §
4.113 and §
4.115 of this title (relating to
Authorized Pits, and Schedule B Authorized Pits); and
(3) recycling is limited to oil and gas
waste; commingling of treated oil and gas waste with other treated fluid from
sources outside of the Commission's jurisdiction may only be authorized at the
Director's discretion.
(b) Treated fluid may be reused in any other
manner without a permit from the Commission provided the reuse occurs pursuant
to a permit issued by another state or federal agency.
(c) Fluid that meets the requirements of
subsection (a) or (b) of this section is a recyclable product.
