16 Tex. Admin. Code § 4.135 - [Effective 7/1/2025] Hearings
(a) The applicant
may request a hearing upon receipt of notice that:
(1) the application has been denied by the
Director;
(2) the Director has
determined the application to be administratively complete but a timely protest
to the application has been received; or
(3) the Director has determined that
additional permit conditions are required to prevent pollution and the
applicant disagrees with the Director's determination.
(b) A request for hearing shall be made to
the Technical Permitting Section within 30 days of the date of the notice of
administrative denial or notice of a timely protest. If the Director receives a
request for a hearing, the Director shall refer the matter to the Hearings
Division for assignment of a hearings examiner who shall conduct the hearing in
accordance with Chapter 1 of this title (relating to Practice and
Procedure).
