16 Tex. Admin. Code § 65.13 - Boiler Installation
(a) The owner or
operator of a boiler in this state must submit a boiler installation report to
the department, in the manner prescribed by the department, not later than the
time of completion of:
(1) a boiler
installation; or
(2) a boiler
reinstallation following relocation or disconnection (as defined in
§65.2(26)).
(b) A
boiler may not be test-fired or operated before the required first inspection
unless the boiler installation:
(1) is
conducted in accordance with the applicable requirements of this chapter,
including but not limited to this section and §§65.50, 65.87, 65.200,
65.201, 65.204, and 65.209;
(2) the
owner, operator, or boiler installer has submitted a boiler installation report
to the department in the manner prescribed by the department; and
(3) a Temporary Boiler Operating Permit has
been approved in accordance with subsection (c).
(c) Temporary Boiler Operating Permit.
(1) The owner or operator may request a
Temporary Boiler Operating Permit in the manner prescribed by the
department.
(2) The owner or
operator must pay the applicable fee provided under §65.300.
(3) The department will not approve a
Temporary Boiler Operating Permit if a boiler installation report for the
boiler has not been submitted to the department in the manner prescribed by the
department.
(4) Upon approval of
the Temporary Boiler Operating Permit from the department, the boiler may be
operated before the required initial inspection for up to thirty (30)
days.
