22 Tex. Admin. Code § 3.170 - Referrals from the Texas Department of Licensing and Regulation
(a) If a Landscape Architect fails to submit
any document to the Texas Department of Licensing and Regulation as required by
the Architectural Barriers Act, or a rule or procedure enacted pursuant to the
Architectural Barriers Act, the Board may take disciplinary action against the
Landscape Architect.
(b) A
Landscape Architect's failure to submit documents to the Texas Department of
Licensing and Regulation as required by subsection (a) of this section shall,
result in a written warning from the Executive Director. An administrative
penalty shall be imposed upon second and subsequent failures.
(c) When considering potential disciplinary
action, including imposition of an administrative penalty, the Board and the
Executive Director shall take into account the number of previous incidents
involving a registrant's failure to timely submit documents to the Texas
Department of Licensing and Regulation and the length of the delay in making
the present submission.
