26 Tex. Admin. Code § 306.154 - Notification and Appeals Process for Local Mental Health Authority or Local Behavioral Health Authority Services
(a)
Any individual who is eligible for Medicaid and whose request for eligibility
to receive LMHA or LBHA Medicaid services is denied or is not acted upon with
reasonable promptness is entitled to a fair hearing in accordance with 1 TAC
Chapter 357, Subchapter A (relating to Uniform Fair Hearings Rules).
(b) Any individual who is eligible for
Medicaid and whose services have been terminated, suspended, or reduced by HHSC
is entitled to a fair hearing in accordance with 1 TAC Chapter 357, Subchapter
A.
(c) Any individual who has not
applied for or is not eligible for Medicaid, whose request for eligibility to
receive LMHA or LBHA services is denied or is not acted upon with reasonable
promptness, or whose services have been terminated, suspended, or reduced by a
provider, is entitled to notification and right of appeal in accordance with
§
301.155 of this title (relating to
Notification and Appeals Process).
(d) At any time, an individual may obtain
additional information and resources on the HHSC website and from the Ombudsman
by calling toll-free 1-800-252-8154.
