26 Tex. Admin. Code § 554.2607 - Penalties for Supplementation
A felony conviction with a fine of not more than $25,000 or imprisonment for not more than five years or both can be imposed on anyone in the facility who knowingly and willfully:
(1) accepts, from the recipient, money or
other considerations in excess of rates established by the state for services
provided under a state plan approved under Title XIX;
(2) charges, solicits, accepts, or receives
any gifts, money, donation, or other consideration in addition to amounts
required to be paid under a state plan approved under Title XIX (other than
charitable donations from an organization or a person unrelated to the
recipient) as a precondition for admitting or keeping a recipient in the
nursing facility; or
(3) accepts
reimbursement from more than one source (including per diem reimbursement) for
the same item or service.
