26 Tex. Admin. Code § 749.3023 - Which rooms in the home may not be used as bedrooms?

(a) Only a room that provides adequate opportunities for rest and privacy may be used as a bedroom.

(b) Bedrooms used by foster children must have at least one source of natural lighting.

(c) Foster children or any other household members may not use any of the following as a bedroom:

(1) A room commonly used for other purposes, including dining rooms, living rooms, hallways, or porches;

(2) A passageway to other rooms; or

(3) A room that does not have doors for privacy.

(d) A foster child may use a detached structure as a bedroom if:

(1) The child is 16 years old or older;

(2) The service planning team approves; and

(3) The detached structure is included in required fire and health inspections for the foster home.

(e) A foster child may use a basement as a bedroom if there is a second fire escape route from the basement.

(f) A foster child may not use a room, including a basement or detached structure, as a bedroom if there is no natural lighting:

(1) Unless you verified the home prior to January 1, 2007; and

(2) Until the verification is no longer valid, or the home is structurally altered through the addition of a new room.
