26 Tex. Admin. Code § 925.10 - Investigation of Allegations of Misconduct in Science
(a) Investigation of
misconduct in science is the formal examination and evaluation of all relevant
facts to determine if misconduct in science has occurred.
(b) All research involving Texas Health and
Human Services Commission (HHSC) services shall be conducted with a fundamental
commitment to high ethical standards regarding the conduct of scientific
research.
(c) Reports of alleged
misconduct in science are made to the IRB2, which must ensure:
(1) each allegation is reviewed and
investigated by an appropriate entity in accordance with 42 Code of Federal
Regulations (CFR) Part 93;
(2) the
investigating entity submits to the IRB2 information documenting the
disposition of each allegation; and
(3) the following are notified of confirmed
incidents of misconduct in science:
(A) the
institutional review board (IRB) that approved the research protocol;
and
(B) the agency funding the
research.
