28 Tex. Admin. Code § 1.203 - Publication and Comments on Proposals for Rule Making
(a) Submission. Publication of proposed rules
shall request that written comments be filed with the Office of the Chief
Clerk, including proposed rules under the Insurance Code, Articles 5.96 and
5.97.
(b) Incorporation Of Forms By
Reference. Notice of a proposed new rule or amendment to an existing rule under
Government Code, Chapter 2001, which includes a new form or a change to an
existing form incorporated by reference in the new or existing rule shall:
(1) include the text of the new form or
proposed change to the existing form; or
(2) state that the proposal includes a new
form or change to the existing form, accompanied by a description of the new
form or change to the existing form sufficiently specific to provide the
substantive detail about the new form or change to the existing form.
(c) Public Comment. Comments on
each published proposal shall be filed with the Office of the Chief Clerk, with
an additional copy to the division contact person in the department for the
proposal if requested in the Texas Register notice.
(d) Request for Hearing. Any person may
request a hearing on a published rule proposal. Unless the request is
withdrawn, the commissioner shall grant the request and hold a
hearing.
