28 Tex. Admin. Code § 3.41 - Standards for Electronic and Telephonic Applications
(a) When conducting business electronically,
an issuer must comply with Insurance Code Chapter 35, concerning Electronic
Transactions.
(b) For all
applications, including applications that involve electronic or telephonic
transactions, the issuer must provide the applicant with a written copy of the
completed application, including any responses given verbally, before the
applicant is asked to sign and submit the application.
(c) The issuer must deliver the completed
written application in a manner that allows the consumer to retain the
information, consistent with Texas Business and Commerce Code §
322.008(a),
concerning Provision of Information in Writing; Presentation of Records, and
Insurance Code §
35.004(c),
concerning Minimum Standards for Regulated Entities Electronically Conducting
Business with Consumers.
