28 Tex. Admin. Code § 34.6 - Retroactivity

This subchapter applies to underground and aboveground storage tanks in service after the effective date of the subchapter except for underground tanks used by retail service stations in service prior to September 1, 1969, to the extent that such stations in service prior to September 1, 1969, do not create a distinct hazard to life and property.
