30 Tex. Admin. Code § 352.101 - Registration Required

(a) Except as provided by § 352.1 of this title (relating to Applicability), a person who manages or disposes of coal combustion residuals (CCR) generated from the combustion of coal at electric utilities and independent power producers in an existing landfill; or an existing, or inactive surface impoundment; shall within 365 days of the effective date of this chapter or 180 days of the United States Environmental Protection Agency's approval of the state's CCR program, whichever is later, file a registration application in accordance with this chapter.
(b) Except as provided by § 352.1 of this title, no person may cause, suffer, or allow the disposal or management of CCR in a new or lateral expansion of a CCR landfill or surface impoundment, unless such activity is authorized by a registration under this chapter, and shall within 365 days of the effective date of this chapter or 180 days of the United States Environmental Protection Agency's approval of the state's CCR program, whichever is later, file a registration application in accordance with this chapter.
(c) The executive director may issue a registration as provided in this chapter. One or more CCR units located at the same facility, and on contiguous property must be authorized under one registration. CCR units located on non-contiguous property may not be authorized under the same registration.
