31 Tex. Admin. Code § 506.32 - Public Notice and Comment
(a) Upon receipt of an
administratively complete consistency certification for a proposed federal
agency action, the council secretary shall publish public notice of the
consistency certification on the council's web site and in the Texas
Register.
(b) The public
notice shall provide a summary of the proposed activity, announce the
availability of the consistency certification for inspection, and request
comment on whether the federal agency action should be referred to the council
for review and whether the action is or is not consistent with the CMP goals
and policies. Comments shall be submitted to the council secretary within 30
days of publication of the notice on the council's web site.
(c) When appropriate, the chair or any three
members of the council may extend the public comment period or schedule a
public hearing on:
(1) the consistency
certification; and
(2) whether
referral to the council is appropriate.
(d) After the close of the public comment
period, the council members shall consider any comments received in response to
the public notice and determine whether the proposed federal agency action
presents a significant unresolved dispute regarding consistency with the CMP
goals and policies and should be placed on the agenda of the council for
review. Upon council members' decision, the council secretary shall immediately
notify all council members, applicant, federal agency, and other affected
parties, if any.
