34 Tex. Admin. Code § 101.14 - Procedure for Obtaining Hearing of Claim Denied in Whole or in Part by Director as Contested Case
(a) A claimant who
desires to contest the action of the director denying, in whole or in part, the
claim to any right or benefit under the Act may obtain a hearing of the claim
as a "contested case" pursuant to the Administrative Procedure Act (Chapter
2001, Government Code) and the following rules, by filing a written "Request
for Hearing of Denied Claim" within 90 days after the date of the director's
letter of notification.
(b) If no
request under subsection (a) of this section is filed by the claimant within
the 90 day period provided above, the prehearing disposition made by the
director shall become final and unappealable.
