34 Tex. Admin. Code § 67.71 - Official Notice

Official notice may be taken of judicially cognizable facts, and such notice may be taken of generally recognized facts within the area of the specialized knowledge of ERS. Parties shall be notified of the material noticed, including any ERS decisions, staff memoranda or data, and they shall be afforded an opportunity to contest the material so noticed. The special skills or knowledge, or both, of ERS and its staff may be utilized in evaluating the evidence.
