37 Tex. Admin. Code § 15.1 - Who Must Be Licensed
All persons, except those expressly exempt by law, who live in Texas and operate a motor vehicle upon a public street or highway must have a valid driver license.
(1) Any person
holding a valid driver license need not obtain any other state permit for the
operation of a motor vehicle on the highway. Some cities, however, issue
special city taxi driver permits by ordinance or state law.
(2) For driver licensing and personal
identification certificate policy purposes, a resident is defined as a person
who actually and physically lives in the State of Texas.
(3) All other persons who do not come within
the scope of the preceding definition of a resident will be classified as
nonresidents.
