37 Tex. Admin. Code § 152.23 - Definitions

The following words and terms, when used in this subchapter, shall have the following meanings, unless the content clearly indicates otherwise.

(1) De minimis increase in maximum rated unit capacity is the addition of 2% or fewer beds to the capacity of a unit on a one-time basis as originally established by the Texas Board of Criminal Justice (TBCJ), and that addition will not increase the monthly gross payroll of the unit to which it is added by $500,000 or more.
(2) Maximum rated unit capacity is the greatest density of inmates in relation to space available for inmate housing as established by the TBCJ.
