37 Tex. Admin. Code § 35.13 - Drug-Free Workplace Policy
(a) In the interest of
creating a safe and drug-free work environment for clients and employees, all
licensed companies shall establish and implement a drug-free workplace policy
consistent with the Texas Workforce Commission's "Drug-Free Workplace
Policy.''
(b) A copy of the
company's drug-free workplace policy shall be signed by each employee and kept
in each employee's file.
(c) For
purposes of subsection (b) of this section, a sole proprietor who performs
regulated services on behalf of the company is considered an employee of the
company.
