37 Tex. Admin. Code § 351.9 - Security and Control
(a) Policy.
Written policies for security and control of the facility shall include the
following:
(1) procedures to continue
operation in the event of a work stoppage;
(2) key control;
(3) control of the use of:
(A) tools;
(B) medical equipment; and
(C) kitchen tools; and
(4) provisions to prevent firearms from
entering the secure area of the facility.
(5) Written procedures for coordination with
law enforcement authorities in the case of riot, rebellion, escape, or other
situations requiring assistance from city, county, or state law enforcement
agencies.
(b) Searches.
Searches shall be conducted according to written policies limited to the
following conditions:
(1) residents may be
required to submit to a pat down/frisk search to prevent concealment of
contraband and as necessary for facility security;
(2) residents may be required to submit to an
oral cavity search to prevent concealment of contraband, to ensure the proper
administration of medication, and as necessary for facility security;
(3) residents may be required to surrender
their clothing and submit to a search as necessary for facility
security;
(4) residents may be
required to undergo an anal or genital body cavity search only if there is
probable cause to believe that they are concealing contraband; and
(5) an anal or genital body cavity search may
be conducted only by a physician.
(c) Special Incidents.
(1) All special incidents including, but not
limited to, riots, rebellion, the taking of hostages, escapes, and assaults
shall be reported in writing to the facility administrator.
(2) A copy of the report shall be placed in
the permanent file of the resident(s) involved in the incident.
(d) Perimeter Security. The
facility shall be constructed so that residents remain within the premises and
the general public is denied access without authorization. Perimeter security
shall be maintained at all times.
