4 Tex. Admin. Code § 1.605 - Process for Evaluating the Dispute; Role of the Department

(a) The dispute shall be evaluated using the definitions and standards provided in the Texas Agriculture Code, Chapters 128 and 188 and any documentation provided by parties in support of their positions.
(b) The department facilitator shall act as an impartial third party in the settlement process with a goal of achieving settlement of the matter between parties. The facilitator may not impose his or her own judgment on the issues for that of the parties.
(c) At the conclusion of the settlement conference, the facilitator shall issue a report on the matter, outlining what, if any, agreements were reached in the process and what, if any, issues still remain to be resolved.
