40 Tex. Admin. Code § 460.52 - Appeal of Corrective Action
(a)
The Grantee may provide a letter of appeal that must be received by the Agency
no later than 14 days after the mailing date of the Corrective Action
letter.
(b) The letter of appeal
shall include:
(1) justification of why the
corrective action should not be imposed;
(2) an explanation of how the Grantee will
correct the noncompliance identified in the Corrective Action letter;
(3) an explanation of how the Grantee will
ensure that any noncompliance identified in the Corrective Action letter will
be avoided in the future; and
(4)
any documents supporting the appeal.
(c) The Agency Executive Director, or his
designee(s), makes the final decision to approve or deny the appeal.
(d) A letter of appeal received after the
deadline stated in subsection (a) of this section shall not be
considered.
(e) The decision of the
Executive Director is final.
