40 Tex. Admin. Code § 460.53 - Appeal of Deobligation of Grant Funds
(a) The Grantee may provide a letter of
appeal that must be received by the Agency no later than 14 days after the
mailing date of the Notification of Deobligation letter.
(b) The letter of appeal shall include:
(1) justification of why the deobligation of
grant funds should not be imposed;
(2) an explanation of how the Grantee will
correct the determinations identified in the Notification of Deobligation
letter;
(3) an explanation of how
the Grantee will ensure that the determinations in the Notice of Deobligation
letter will be avoided in the future; and
(4) any documents supporting the
appeal.
(c) The
Commission makes the decision to approve or deny the appeal.
(d) A letter of appeal received after the
deadline stated in subsection (a) of this section shall not be
considered.
(e) The decision of the
Commission is final.
