40 Tex. Admin. Code § 700.1501 - Decision on Foster Home Applications
(a)
To be accepted as a foster home, the home must meet the department's minimum
standards, and the Texas Department of Family and Protective Services (DFPS)
must have determined, through the foster-home screening, that the parents can
provide adequate care for foster children in the department's managing
conservatorship and that they will follow the department's policies for
discipline of these children as specified in §
700.1502(2)(K)
of this title (relating to Foster and Adoptive Home Inquiry and
Screening).
(b) Relative homes
verified to provide foster care services to related children must meet the same
requirements as non-relative foster homes. The Residential Child-Care Licensing
Division of DFPS will consider requests for waivers and variances to minimum
standards for relative foster homes on a case-by-case basis in accordance with
applicable statutes, rules, and policies on waiver and variance requests for
foster homes.
