43 Tex. Admin. Code § 21.3 - Title Requirements for Highway Right-of Way

It is preferred procedure of the department to acquire fee title, excluding oil, gas and sulphur, to the right-of-way proper. An easement interest will be acquired in land not included in the right-of-way proper which is required for drainage channels, detours, highway construction, or other auxiliaries to the right-of-way.
