43 Tex. Admin. Code § 218.80 - Purpose and Scope
(a) The purpose of this subchapter is to comply with Transportation Code, §
648.102. For the purposes of this subchapter, the term "motor carrier" is defined by Transportation Code, §
648.001, and does not include the following, except as provided by subsection (b) of this section:
(1) a motor carrier that is required to register with the department under Transportation Code, Chapter 643; or
(2) a motor carrier that is required to register with FMCSA for interstate transportation, and is not operating in intrastate transportation within this state.
(b) If a motor carrier is required to register with the department under Transportation Code, Chapter 643, the motor carrier must comply with the financial responsibility requirements in §
218.16 of this title (relating to Insurance Requirements).
