Utah Admin. Code R151-4-709 - Burden of Proof
Unless otherwise provided by statute:
(1) the department has the burden of proof in
a proceeding initiated by a notice of agency action; and
(2) the party who seeks action from the
department has the burden of proof in a proceeding initiated by a request for
agency action.
