Utah Admin. Code R307-415-6b - Permit Content: Federally-Enforceable Requirements
(1) All terms and conditions in an operating
permit, including any provisions designed to limit a source's potential to
emit, are enforceable by EPA and citizens under the Act.
(2) Notwithstanding (1) above, applicable
requirements that are not required by the Act or implementing federal
regulations shall be included in the permit but shall be specifically
designated as being not federally enforceable under the Act and shall be
designated as "state requirements." Terms and conditions so designated are not
subject to the requirements of R307-415-7 a through 7i and
R307-415-8 that apply to permit review by EPA and affected states. The director shall
determine which conditions are "state requirements" in each operating
permit.
