Utah Admin. Code R307-415-7e - Permit Revision: Administrative Amendments
(1) An "administrative permit amendment" is a
permit revision that:
(a) Corrects
typographical errors;
(b)
Identifies a change in the name, address, or phone number of any person
identified in the permit, or provides a similar minor administrative change at
the source;
(c) Requires more
frequent monitoring or reporting by the permittee;
(d) Allows for a change in ownership or
operational control of a source where the director determines that no other
change in the permit is necessary, provided that a written agreement containing
a specific date for transfer of permit responsibility, coverage, and liability
between the current and new permittee has been submitted to the
director;
(e) Incorporates into the
operating permit the requirements from an approval order issued under R307-
401, provided that the procedures for issuing the approval order were
substantially equivalent to the permit issuance or modification procedures of
R307-415-7 a through 7i and
R307-415-8,
and compliance requirements are substantially equivalent to those contained in
R307-415-6 a through 6g;
(2) Administrative permit amendments for
purposes of the acid rain portion of the permit shall be governed by
regulations promulgated under Title IV of the Act.
(3) Administrative permit amendment
procedures. An administrative permit amendment may be made by the director
consistent with the following:
(a) The
director shall take no more than 60 days from receipt of a request for an
administrative permit amendment to take final action on such request, and may
incorporate such changes without providing notice to the public or affected
States provided that the director designates any such permit revisions as
having been made pursuant to this paragraph. The director shall take final
action on a request for a change in ownership or operational control of a
source under (1)(d) above within 30 days of receipt of a request.
(b) The director shall submit a copy of the
revised permit to EPA.
(c) The
source may implement the changes addressed in the request for an administrative
amendment immediately upon submittal of the request.
(4) The director shall, upon taking final
action granting a request for an administrative permit amendment, allow
coverage by the permit shield for administrative permit amendments made
pursuant to (1)(e) above which meet the relevant requirements of
R307-415-6a through 6g, 7 and 8 for significant permit modifications.
