Utah Admin. Code R313-25-32 - Financial Assurances for Institutional Controls
(1) Prior to the issuance of the license, the
applicant shall provide for Director approval, a binding arrangement, between
the applicant and the disposal site owner that ensures that sufficient funds
will be available to cover the costs of monitoring and required maintenance
during the institutional control period. The binding arrangement shall be
reviewed annually by the Director to ensure that changes in inflation,
technology, and disposal facility operations are reflected in the
arrangements.
(2) Subsequent
changes to the binding arrangement specified in Subsection R313-25-32(1)
relevant to institutional control shall be submitted to the Director for prior
approval.
