Utah Admin. Code R315-309-1 - Applicability
(1) The owner or operator of any solid waste
disposal facility subject to the requirements for a permit under Subsection
R315-310-1(a), or as otherwise required by the director, shall establish
financial assurance sufficient to assure adequate closure, post-closure care,
and corrective action, if required, of the facility by compliance with one or
more financial assurance mechanisms acceptable to and approved by the
director.
(2) Financial assurance
is not required for a solid waste disposal facility that is owned or operated
by this state or the federal government.
(3) Existing Facilities.
(a) An existing facility shall have the
financial assurance mechanism in place and effective according to the
compliance schedule as established for the facility by the director.
(b) In the case of corrective action, the
financial assurance mechanism shall be in place and effective no later than 120
days after the corrective action remedy has been selected.
(4) A new facility or an existing facility
seeking lateral expansion shall have the financial assurance mechanism in place
and effective before the initial receipt of waste at the facility or the
lateral expansion.
