Utah Admin. Code R315-320-1 - Authority, Purpose, and Inspection
(1) Requirements for waste tire transporters
and recyclers, as defined by Section
19-6-803, are promulgated under
the authority of the Waste Tire Recycling Act, Title 19, Chapter 6, and the
Solid and Hazardous Waste Act Title 19, Chapter 6, to protect human health; to
prevent land, air and water pollution; to conserve the state's natural,
economic, and energy resources; and to promote recycling of waste
tires.
(2) Except for Subsections
R315-320-4(7)
and R315-320-5(7),
which apply to the application fees for the registration of a waste tire
transporter and a waste tire recycler throughout the state, Rule R315-320 does
not supersede any ordinance or regulation adopted by the governing body of a
political subdivision or local health department if the ordinance or regulation
is at least as stringent as Rule R315-320, nor does Rule R315-320 relieve a
tire transporter or recycler from the requirement to meet any applicable local
ordinances or regulations.
(3) The
director or an authorized representative may enter and inspect the site of a
waste tire transporter or a waste tire recycler to verify compliance with Rule
R315-320.
