Utah Admin. Code R33-107-601 - Best and Final Offers
Best and Final Offers (BAFO) shall be conducted in accordance with the requirements set forth in Section 63G-6a-707.5. Rule R33-107 provides additional requirements and procedures and must be used in conjunction with the Utah Procurement Code.
(1)
BAFO process is an optional step in the evaluation phase of the RFP process in
which offerors are requested to modify their proposals.
(2) The BAFO process may not be conducted as
part of the contract negotiation process. It may only be conducted during the
evaluation phase of the RFP process.
(3) A procurement unit may not use the BAFO
process to allow offerors a second opportunity to respond to the entire
RFP.
