Utah Admin. Code R331-9-7 - Form of Pleadings
(1) All
pleadings filed with the department shall comply with the requirements of Rule
10 of the U.R.C.P. except for the caption specified in subparagraph (a)
thereof. The caption for all pleadings filed with the department shall indicate
that the matter is before the Department of Financial Institutions of the State
of Utah. In the case of a comment hearing, the documents shall identify the
subject matter of the hearing and the subject matter of the particular
pleading. In the case of a dispute or adjudicative hearing, the pleadings shall
identify all parties to the proceeding, shall separately state that the
proceeding is dispute or adjudicative, that it is confidential or not
confidential, the subject matter of the pleading, and any case number which may
have been assigned to that proceeding by the department. A document that
substantially complies with Rule 10 of the U.R.C.P. will be
acceptable.
(2) The provisions of
Rule 11 of the U.R.C.P. shall apply to all pleadings filed with the department
by any attorney representing a party.
