Utah Admin. Code R357-39-104 - Eligibility Criteria
(1) A business
representative shall certify that:
(a) the
business has a skilled labor gap;
(b) the proposed grant will meet the gap
need; and
(c) the business has
significant one-time or ongoing hiring and training demands.
(2)
(a) To qualify a business shall have a
substantial or potential presence in Utah, as determined by the office, by
weighing:
(i) the total workforce and
percentage of business's workforce in Utah;
(ii) the amount of business taxes paid to
Utah;
(iii) the relative size of
the business;
(iv) whether the
business's principal place of business is Utah;
(v) the likelihood that the business will
maintain a significant presence in Utah;
(vi) the degree to which the business's
activities and operations positively impact Utah's economy;
(vii) the business's registration with the
Utah Division of Corporations and Commercial Code as an active, for-profit
business entity; and
(viii) the
business's license in the appropriate city or county.
