Utah Admin. Code R457-1-403 - Additional Procedures for Immediate License Suspension
(1) Under Section 9-23-303, the designated
Commission member, or in the absence of a designated Commission member the
Director may issue an order immediately suspending the license of a licensee
upon a finding that the licensee presents an immediate and significant danger
to the licensee, other licensees, or the public.
(2) The suspension shall be at such time and
for such period as the Commission believes is necessary to protect the health,
safety, and welfare of the licensee, other licensees, or the public.
(3) A licensee whose license has been
immediately suspended may, within 30 days after the decision of the designated
Commission member, challenge the suspension by submitting a written request for
a hearing to the Director. The Commission shall schedule the hearing as soon as
is reasonably practical but before 30 days from the receipt of the written
request, unless the Commission and the party requesting the hearing agree to
conduct the hearing at a later date.
