Utah Admin. Code R477-7-8 - Witness and Jury Leave
(1) An employee is
entitled to a leave of absence from a regularly scheduled work day with full pay
when, in obedience to a subpoena or direction by proper authority, the employee
shall:
(a) appear as a witness as part of the
employee's position for the federal government, the State of Utah, or a political
subdivision of the state;
(b) serve as a
witness in a grievance hearing under Section 63A-17-602 and Title 67, Chapter 19a,
Grievance Procedures; or
(c) serve on a
jury.
(2) An employee on jury
leave may accrue excess hours in the same pay period during which the jury leave is
used.
(3) An employee choosing to use
accrued leave while on jury duty may keep juror's fees;
(4) An employee who chooses to take a leave of
absence from a regularly scheduled work day with full pay while on jury duty shall
return any juror's fee to agency finance or agency payroll staff for deposit with
the State Treasurer.
(5) An employee may
not use work time or witness and jury leave when absent to litigate matters
unrelated to state employment.
